Terms of Sale

1. Who is selling

The seller is Artifex Fine Art LLC, a limited liability company registered in the United States. Our legal name, registered address and state of registration appear on every invoice. "We" and "us" in these terms mean that company; "you" means the buyer.

2. What is being sold

Each work is sold as a decorative work of art, made by hand, described by what we can see, as set out in How We Describe. That page forms part of these terms. No representation is made as to the age, period, maker, school, provenance or material composition of any work, and none is to be implied from its style, mounting, inscriptions, seals or from anything said in correspondence.

3. Prices

Prices are shown on each work's page in United States dollars and include packing. They do not include shipping, insurance, sales tax or import duty. We may change a price at any time before a sale is agreed. A sale is agreed when we issue an invoice and you accept it by paying.

4. Payment

Payment is by bank transfer or card, in full, against our invoice. We hold a work for seven days from the date of invoice; if payment has not arrived by then we may release the work for sale to others. Title to a work passes to you when we receive payment in full. Risk passes to you on delivery.

5. Delivery

We pack every work ourselves and ship it insured, door to door, to the address on the invoice, on the terms in Shipping & Returns. Delivery dates are estimates. If a work is lost or damaged in transit we deal with the insurer and either replace, repair, or refund you in full at your choice.

6. Returns

Any work bought without being seen in person may be returned within fourteen days of delivery for any reason, on the terms in Shipping & Returns. Works re-mounted, framed or altered to your instruction are excluded. If a work is not as described, you may return it at any time within fourteen days of delivery for a full refund including all shipping.

7. Inscriptions, seals and marks

Inscriptions, signatures, seals, labels and other marks on any work or its mounting are described as they appear. They are part of the object. They are not offered as evidence of date, origin, authorship or provenance, we have not translated them, and no claim is made that any work was made by the person or in the period they may name.

8. Condition

Works are sold in the condition described on their page and in any condition note we send you before payment. Ordinary marks of age and handling, and irregularities of paper, silk, mounting or frame, are not faults. We will answer any question about condition, and send further photographs, before you pay.

9. Our liability

Our liability to you in respect of any work is limited to the price you paid for it, plus any shipping paid to us. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for fraud.

10. Photographs and text

The photographs and text on this site are ours. You may reproduce them to show a work to your client, framer or insurer; any other use needs our written permission.

11. Governing law

These terms and every sale are governed by the laws of the state named on the invoice and of the United States, and any dispute is subject to the courts of that state. Nothing in this clause removes protections you have under the law of the place where you live.

12. Changes

We may change these terms at any time. The terms that apply to a sale are those on this page on the date of the invoice, and we send a copy with the invoice.
